Discount Tackle™ and the MetaCommerce family respects your privacy and trust. The short version of all of this is that we operate legally and do our best to keep up with and follow all the (ever-changing) laws around privacy. We’re decent people and, when in doubt, we strive to do the right thing based on our best judgment and information that we have available. We don’t do anything weird or evil with your data, but if you’re concerned, just contact us and we’ll answer any questions, delete your data, and/or review/update policies and processes to consider new rules (made by states and localities about technologies they don’t always understand and where there are very few standards). Unfortunately, thanks to the attorneys, this privacy policy is long and detailed, but that is because we live in a litigious world, and we must do our best to cover our butts as much as we can. We appreciate your trust and promise to be responsible with your data and privacy. Now, on to the long version with all the legal stuff…
This Privacy Policy explains how information about you is collected, used and disclosed by MetaCommerce, Inc and its subsidiaries (MetaCommerce, Discount Tackle™ or we). This Privacy Policy applies to information we collect across our Brands when you use our websites, mobile apps, retail stores, and other online products and services (collectively, the Services), including the Services we provide for MetaCommerce, and our other Brands (like Discount Tackle™, Haiku Designs, Pro Tackle Solutions and Departure Outdoors®), and when you otherwise interact with us. This policy does not apply to products or services with separate privacy policies that do not incorporate this Privacy Policy.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification). We encourage you to review the Privacy Policy regularly to stay informed about our information practices and the choices available to you.

We do not have control over these third-party websites, and you should review the privacy practices of third parties where you choose to submit a review.

You may opt out of receiving promotional emails from each of our Brands (like Discount Tackle™, Haiku Designs, Pro Tackle Solutions, Departure Outdoors®) by following the instructions in emails from each brand or by changing the preferences through your online account with each brand. If you opt out, we may still send you non-promotional emails, such as those about your account, transactional emails or our ongoing business relations. Additionally, the proper way to unsubscribe from email is to use the unsubscribe link in the email, which automatically removes your address. Attempting to request removal in other ways than this may take longer, may not arrive to the proper person, or may be overlooked due to human error. We’ll do our best, but please use the unsubscribe link.
With your consent, you may receive promotional calls from us. You may opt out of receiving these communications by letting us know during one of those calls.
With your consent, you may receive recurring automated marketing text messages from Discount Tackle™, Haiku Designs or Departure Outdoors®, including text messages that may be sent using an automatic telephone dialing system. Consent to receive automated marketing text messages is not a condition of any purchase. You can opt out of receiving further marketing text messages by responding to any of our text messages with any of the following replies: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. Our text messaging platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE, OR QUIT commands. If you unsubscribe from one of our Brand’s marketing text messaging programs (e.g., Discount Tackle™), you may continue to receive marketing text messages through any other brand program (e.g., Haiku Designs) you have joined until you separately unsubscribe from those programs. For more information, please refer to the Mobile Terms of Service section of Terms of Use.
You may receive catalogs and other print mail pieces from our Brands. You may opt out of receiving direct mail marketing by adjusting your communication preferences with the Brand that sent the direct mail communication or by emailing us at legal@metacommerce.com.

If you are a resident of states such as California, Colorado, Connecticut, or Virginia, you may have certain privacy rights under the applicable privacy laws in your state. This section describes those rights and how you can exercise them.
The Colorado Privacy Act (CPA), Connecticut Data Privacy Act (CTDPA), and Virginia Consumer Data Protection Act (VCDPA) afford consumers residing in those states rights with respect to their personal information. Subject to certain limitations and exceptions, the CPA, CTDPA, and VCDPA provide residents in those states the right to request (1) to confirm whether or not we are processing your personal information; (2) to access a copy of the personal information you have previously provided to us; (3) to request deletion of their personal information; (4) to correct inaccurate personal information; (5) to not be discriminated against for exercising these rights; and (6) the right to opt out of the processing of personal information for targeted advertising.
We do not process personal information for the purpose of profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. We do not sell personal information for money.
Colorado, Connecticut, or Virginia consumers may opt out of the collection of cookie-based data by third parties for use in targeted advertising by disabling cookies in your web browsers, which may affect usability of the website. Colorado, Connecticut, or Virginia consumers may make additional rights requests by contacting us at legal@metacommerce.com, or by calling us at 1-800-940-5490. All rights requests must be accompanied by your online contact information, phone number and physical mailing address so we can comply fully with privacy right requests.
If we decline to take action in response to your exercise of a privacy right, we will inform you of the reason for the denial. Where provided by statute, you may have the right to appeal our decision. We will provide you with instructions on how to appeal the decision in response to your privacy request. If you are unsatisfied with our response to your appeal, you may contact your state Attorney General’s office.
The California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA) and the Shine the Light law afford California residents certain rights with respect to their personal information. If you are a California resident, this section applies to you.

For more details about the personal information we collect, including the categories of sources, please see the Collection of Information section above. We collect this information for the business and commercial purposes described in the Use of Information section above.
In the preceding 12 months, we have disclosed the following categories of personal information for business purposes to the following categories of recipients:
Categories of personal information we collect
Parties with whom information may be disclosed
MetaCommerce does not collect or process sensitive personal information for the purpose of inferring characteristics about you. Nor do we use, or disclose to a service provider or contractor, sensitive personal information for purposes other than what the CPRA authorizes.
California law requires that we provide transparency about scenarios in which MetaCommerce sells or shares personal information with third parties in exchange for valuable consideration or for certain marketing. We do not sell your personal information for money. Instead, like many retailers, we share personal information to certain third parties to market and advertise our products to you.
In the preceding 12 months, we have shared identifiers (such as your email address, postal address and other online identifiers) with advertising networks and print catalog marketing partners, and electronic network activity information (such as browsing behavior) to advertising networks.
If you are a California resident, you have the right to opt out of these sales at any time, however, because we do not sell your personal information, you don’t need to worry. You may opt out of the collection of cookie-based data by third parties for use in targeted advertising by turning off cookies in your web browser, although this may affect usability of the website.
We do not knowingly sell or share personal information about consumers under the age of 13.
Subject to certain limitations and exceptions, the CPRA also provides California residents the right to request (1) to know more details about the categories or specific pieces of personal information we collect, use, disclose and sell/share, (2) deletion of their personal information, and (3) to not be discriminated against for exercising these rights., (4) that we correct inaccurate personal information; and (5) to opt out of the sale/share of personal information, as discussed above.
Automated decision making is the process of making a decision by automated means without any human involvement. We do not process personal information for automated decision making that results in legal or similarly significant effects concerning the consumer.
California, Colorado, Connecticut, or Virginia consumers may make a rights request by visiting this portal, by contacting us at legal@metacommerce.com, or by calling us at 1-800-940-5490. Prior to processing certain requests, we will verify your request by asking you to provide information related to your recent interactions with us, such as information about a recent purchase.
If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. If you are an authorized agent seeking to make a request, please email us at legal@metacommerce.com.
California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. Under the law, a business must either provide this information or permit California residents to opt in to, or opt out of, this type of sharing. If you would like to opt out, please unsubscribe from our mailing list, and if applicable, mobile lists, as these are the keys to that program and then contact us regarding your Shine the Light request and we’ll provide you with all of the details you need so you are satisfied that we have complied.
Some web browsers incorporate a “Do Not Track” (DNT) or similar feature that signals to web services that a visitor does not want to have their online activity and behavior tracked. Historically, there has not been consensus on what constitutes a DNT signal, so many web sites do not honor them, including this one. For more information about DNT signals, visit http://allaboutdnt.com.
You may use an Opt-Out Preference Signal, such as the Global Privacy Control (GPC), to opt-out of the sale/share of your personal information. If our hosted platform is able to detect and recognize such a signal from your browser, and handle it meaningfully, we will honor it. Your request to opt-out of sale/sharing will be linked to your browser identifier only. Since our websites are hosted on the Shopify Platform, the ability to respond accordingly with the technology depends on their implementation.
Except as otherwise permitted or required by law, we will only retain your personal information for as long as necessary to fulfill the purposes for which we collected it, as required to satisfy any legal, accounting, or reporting obligations, or as necessary to resolve disputes. To determine the appropriate retention period for personal information, we consider our statutory obligations, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information, and whether we can achieve those purposes through other means.
Under some circumstances we may anonymize or de-identify your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified information for any business purpose without further notice to you or your consent.
